Terms of Service

1. Agreement

These terms are an agreement between you and Railspeed AI Limited ("RailSpeed AI", "we", "us") for the use of Firmus and railspeed.ai. If you use Firmus for an organization, you confirm you are authorized to accept these terms for it.

2. The service

Firmus connects to your CRM, uses AI to plan campaigns and write copy, and sends the campaigns your team approves. We may improve or change features over time.

3. Accounts

Keep your account information accurate and your login details secure. You are responsible for activity by users on your account.

4. Plans and billing

Firmus is billed per user on the Pro or Ultra plan, monthly or annually. Annual plans cost the equivalent of ten months. Prices are in US dollars and exclude taxes. Plans renew automatically until cancelled; cancel before the renewal date to avoid the next charge. Except where required by law, fees already paid are not refundable.

5. Your data

You own the data you bring into Firmus. You give us permission to process it only to provide and support Firmus for you. Our Privacy Policy explains how we handle personal information.

6. Acceptable use

You agree to:

• email only contacts who have consented to hear from you, as required by CASL, CAN-SPAM and other applicable laws;
• keep the unsubscribe link in every email and honour opt-outs promptly;
• not send spam, deceptive, unlawful or harmful content;
• follow the usage policies of the AI providers behind Firmus, including Anthropic's Usage Policy;
• not attempt to reverse engineer, overload or get around the limits of Firmus.

7. AI-generated content

Firmus uses AI to draft plans and copy. AI output can be inaccurate or unsuitable, so review it before you approve a campaign. You are responsible for the content you approve and send.

8. Third-party services

Integrations such as Salesforce and HubSpot are governed by their own terms. We are not responsible for third-party services.

9. Suspension and termination

You can stop using Firmus at any time. We may suspend or end access if these terms are breached, especially the acceptable use rules, or if required by law.

10. Disclaimers

Firmus is provided "as is". To the extent permitted by law, we make no warranties beyond those stated in these terms, and we do not guarantee specific campaign results.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability is limited to the fees you paid us in the 12 months before the claim.

12. Governing law

These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Disputes will be resolved in the courts of Alberta.

13. Changes

We will post any changes to these terms on this page and update the date above.
